Bail After Arrest

To secure the grant of post-arrest bail, the accused has to prove before the court that the evidence gathered against the accused is doubtful, and that the accused holds such a position in society that he is not a flight risk, that he cannot tamper with the prosecution evidence, that he has no prior conviction or criminal record, and that if the accused is kept in jail there is no benefit to the prosecution from it — the accused is being kept confined in jail, but the prosecution is not producing its evidence; that if the accused is released on bail, there is no harm to the prosecution in any respect; that the accused, once released on bail, will not repeat the offence; and that, in exchange for this release, the accused is prepared to produce a surety before the court.
