اسلام علیکم۔ ہم دو سگے اور دو سوتیلے بھای ہیں۔ ہماری والدہ حیات ہیں والد کا انتقال ہو گیا ہے۔ ٹوٹل 5 حصے دار ہیں۔ تقسیم کا طریقہ کیا ہو گا۔ جو حصہ دار اپنا حصہ نہی لینا چاہتا اس سے کیا ڈاکیومنٹ دارکار ہو گا۔

Asalam u alekm. hope you will be fine sir. you are helping alot of general people through these questions and answers. i would like to ask a question. my grandfather transfered 48 kanal land to my father as tamleeq back in 1980s. after few years he wanted that land back as he married again . he went to court but 3-4 years after courts they decided to settle the matter outside. the seniors of our locality announced that the revenue from land will be given to my grandfather till his death upon which my dad complied and did what they were told. after the death of my grandfather revenues will be taken by my father. this was signed and stamped on stamp paper and all my aunts had their signatures over it. now one of my cousin is filing a case to break that tamleeq. besides that my uncles got more share than my father in virasat and my father gave the due share of all my aunts in virasat. i would like to ask if they can win this case of 48 kanals now after 40 years of tamleeq. the land is under my father name since 1980 and he has the possession since then. thanks

Dear Sir, We have 1 family home which was built by my father and eldest brother because they used to run business together in UAE. Due to absence of my father in Pakistan at that time, the land and home was registered under ownership of my mother. Years after, due to disputes among family, my mother transferred the ownership/authority of the house to my eldest brother's wife, as law at that time didnt allow her to put the house on my eldest brother's name. I want to know on behalf of my father that is there any law which can protect the rights of all brothers and sisters.
